À propos des crimes de haine anti-LGBT: théorisation, législation et perspectives en droit pénal suisse
Summary
Research on (anti-LGBT) hate crimes has grown significantly in common law countries over the past three decades but remains overlooked in Switzerland, where the paucity of research is particularly striking, even more since the term anti-LGBT hate crime entered political discourse in 2020. This paper first traces the definitional boundaries of (anti-LGBT) hate crimes, before discussing the justification for legislating against anti-LGBT hate crimes. It eventually assesses the possibilities to deal with anti-LGBT hate crimes in Swiss criminal law de lege lata and de lege ferenda.
